Alina Habba has resigned as New Jersey's top federal prosecutor. This comes after a court battle that invalidated her eligibility to serve.

Official Departure

US Attorney General, the Attorney General, confirmed her stepping down on Monday. In a statement that the court's "flawed" ruling made it unworkable for the official to lead the department effectively.

"Let no one confuse compliance for surrender," she declared. "My fight will now extend throughout the nation."

Judicial Challenge

Habba's exit follows closely on a judicial panel found that she had been serving in violation of the law as the top prosecutor. This ruling is expected to impact many legal proceedings in New Jersey.

The appellate judges ruled that a acting appointment that bypassed Senate approval ran afoul of the statute on vacant positions.

Next Steps and Responses

The Attorney General added that Habba will continue working within the DOJ as a high-level advisor. She will challenge the decision of the disqualification, aiming for a reversal.

On a social media platform, the Attorney General contended that judges "cannot be permitted to override the President's choice of lawyers tasked with executing the executive branch's core responsibility of criminal prosecution."

Performance in Office

The attorney general praised her tenure and pointed out that during her run, the city of Newark saw a significant drop in crime. Additionally that the southern city of Camden recorded its first summer in half a century free from homicides.

Background and Previous Role

The 41-year-old attorney, was initially recruited to Trump's personal legal team in recent years. Subsequently, she defended Trump in his business records case in 2024, leading to his guilty verdict on dozens of charges of financial record manipulation.

Earlier, Habba took on the role of US Attorney, Trump had revealed he was naming her as his presidential counsellor if re-elected, calling her as deeply loyal and a dedicated fighter for justice.
