US Judge Orders Release of Abrego Garcia from ICE Custody

Courtroom proceedings

A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling allegations, he was detained in immigration custody.

In her decision, the court noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The court proceedings center on disputed claims. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

Conditions of Release

The court, who was hearing his challenge to deportation in a Maryland district court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.

This decision marks a notable turn in a complicated immigration battle involving claims of mistaken imprisonment and contested criminal associations.
